Addressing a business challenge:
A long-serving employee of the company does not perform the tasks assigned to him or performs them negligently for the last 3 months, conflicts with other employees and customers, and is unresponsive to comments from his line manager. Attempts have been made to talk to the employee about the termination of his employment contract, but he does not agree and threatens to go to the Labour Disputes Commission. The company’s manager wants to terminate the employment contract of the employee but is not sure how to do it in a fair way to the satisfaction of both parties and to avoid legal disputes.
Client’s objective:
To amicably terminate the employment relationship with the employee.
What we did:
We analysed and looked into the company’s problem situation. We discussed with the company’s manager and the employee’s line manager all the possible solutions and alternatives to the problem and provided our insights. We selected the most appropriate termination option, prepared the documentation, and drew up a plan and guidelines for the interview with the employee.
Results of the change:
The company received professional HR consultancy, objective and broader assessment of the situation and insights, avoided the risk of legal issues related to the problem, and successfully terminated the employment relationship with the employee.
